These Terms and Conditions govern the use of www.peaceloveandpets.com.au which is an ecommerce site owned and operated by Peace Love and Pets. By using this site, you have indicated that you have read and understood these terms and conditions and agree to abide by them at all times.

eCommerce

A contract for sale will not be entered into until Peace Love and Pets has confirmed your order, our ability to deliver goods, and have sent you a tax invoice for payment and delivery. Goods will not be shipped until delivery charges have been confirmed and payment for both goods and delivery have been receipted by Peace Love and Pets in full.

Intellectual Property

All content published and made available on this site is the property of Peace Love and Pets and the site's creators. This includes, but is not limited to, images, text, documents, downloadable files, and anything else that contributes to the composition of the site.

Sales of Goods

Pet Treats, Pet Toys, and Pet Accessories are available for sale on this site. These terms and conditions govern the sale of these goods, and apply to all items displayed in our Shop at the time you access it, including items listed as being out of stock. All images and information we provide about our stock and goods for sale are as accurate as possible, however we can not be legally bound by this information and you purchase goods from this site at your own risk. We reserve the right to modify, reject, or cancel your order if necessary. If we cancel your order after payment has been received, you will be given a refund equal to the amount that you paid.

Payment

We can accept payment for online orders by a bank transfer, or bank card using the payment options at Checkout, or the Stripe payment feature on your invoice. If purchasing from us at one of our pop-up retail outlets, we can also accept payment by cash, and eft using our Square device. If you are purchasing our products through one of our retail partners (and not through Peace Love and Pets directly) you will be subject to their terms and conditions of sale and will need to discuss this with them directly.

If we believe your payment has violated any laws or these terms and conditions, we reserve the right to cancel or reverse your transaction.

Refunds and Returns

Refund - you can request a refund on any purchased items within 2 days of receiving your goods. Refunds may be provided if a) the goods do not match the description or b) the goods do not meet your expectations. 

Returns - Returns can be made in person or by mail. If returning by mail, you will need to go to your closest post office and pay the necessary postage for the return.

Consumer Protection Law

Where the Australian Consumer Law, Schedule 2 of the Competition and Consumer Act 2010, or any other consumer protection legislation in your jurisdiction applies and cannot be excluded, these terms and conditions will not limit your legal rights and remedies under that legislation. These terms and conditions will be read subject to the mandatory provisions of that legislation. If there is a conflict between these terms and conditions and that legislation, the mandatory provisions of that legislation will apply.

Limitation of Liability

Peace Love and Pets and our directors, officers, agents, employees, subsidiaries, and affiliates will not be liable for any actions, claims, losses, damages, liabilities, and expenses including legal fees arising out of your use of our site or your violation of these terms and conditions.

 Indemnity

Except where prohibited by law, by using this site you indemnify and hold harmless Peace Love and Pets and our directors, officers, agents, employees, subsidiaries, and affiliates will not be liable for any actions, claims, losses, damages, liabilities, and expenses including legal fees arising out of your use of our site or your violation of these terms and conditions.

Applicable Law

These terms and conditions are governed by the laws of the State of Queensland.

Dispute Resolution

Subject to any exceptions specified in these terms and conditions, if you and Peace Love and Pets are unable to resolve any dispute through informal discussion, then you and Peace Love and Pets agree to submit the issue first before a non-binding mediator and to an arbitrator in the event that mediation fails. The decision of the arbitrator will be final and binding. Any mediator or arbitrator must be a neutral party acceptable to both you and Peace Love and Pets. The cost of any mediation or arbitration will be paid by the unsuccessful party. Notwithstanding, any other provisions in these terms and conditions, you and Peace Love and Pets agree that you both retain the right to bring an action in small claims court and to bring an action for injunctive relief or intellectual property infringement.

Changes

These terms and conditions may be amended from time to time in order to maintain compliance with the law and to reflect any changes to the way we operate our site and the way we expect users to behave on our site. We will notify users by email of changes to these terms and conditions, or post a notice on our site.
